HIPAA  

The Health Insurance Portability and Accountability Act of 1996, as amended, and related regulations (“HIPAA”) establishes national standards for the privacy and security of certain protected health information (PHI). The City of Henderson has some divisions that perform functions that are subject to HIPAA and others that are not and, therefore, designated itself as a “hybrid entity.” This webpage contains links to various forms available in connection with the City’s HIPAA compliance program and contact information for the City’s HIPAA Privacy Officer. 


Notices of Privacy Practice 

The following Notices of Privacy Practice describe how protected health information may be used and disclosed as it relates to the City’s Emergency Medical Services, Group Health Plan and Crisis Response Team:


Authorization to Use/Disclose PHI 

Under HIPAA, an authorization is a detailed document that gives the City permission to use protected health information (PHI) for specified purposes or to disclose PHI to a third party specified by the person who is the subject of the PHI (the “Individual”) or their personal representative. Without a valid authorization, the City is limited in how it may use or disclose PHI. 


Requests Concerning PHI

An Individual (or their personal representative) may: 

  • Request access to their PHI 

  • Request an amendment of their PHI 

  • Restrict or limit the use or disclosure of their PHI 

  • Revoke a prior authorization to use or disclose their PHI. (A revocation will be effective immediately but will not affect actions already taken based on and in compliance with the authorization.) 

  • Request an accounting of disclosures of their PHI 

  • Request to be contacted at a different place(s) or in a different manner by the City 

If the Individual or their personal representative would like to do any of the above, please fill out, sign, and submit the City’s request form. 


Law Enforcement Request for PHI 

HIPAA allows the City to cooperate with law enforcement in their investigation of crimes and the protection of victims in accordance with 45 CFR §164.512(f). If a law enforcement official is authorized to receive PHI, please make an official request to obtain permitted disclosure of PHI by filling out, making any requiring representations, signing, and submitting the City’s law enforcement PHI request form for:
  1. PHI pursuant to an administrative subpoena or summons, a civil or an authorized investigative demand, or similar process authorized under law
  2. PHI to identify and locate a person who is a suspect, fugitive, material witness, or missing person
  3. PHI about a victim of a crime

Complaint Process 

If you believe the City violated your (or someone else’s) health information privacy rights or committed another HIPAA violation, you may file a complaint with the United States Department of Health and Human Services (“DHHS”) by mail, fax, email, or via the Office of Civil Rights Complaint Portal.

You may also file a complaint with the City:

  1. about the City’s HIPAA policies and procedures,
  2. about the City’s compliance with the HIPAA rules or the City’s HIPAA policies and procedures, or
  3. if you believe the City violated health information privacy rights under HIPAA

Please fill out, sign, and submit the City’s Complaint form. You are not required to use this form and may write a letter or submit a complaint electronically to the City with the same information. Submitting a complaint is voluntary.
