Animal Permits and Applications for Fancier, Breeder, Handler and Establishment

Information regarding animal laws within the City of Henderson are found in the Henderson Municipal Code, commonly referred to as HMC. Pet Fancier

HMC 7.04.100 A pet fancier, as defined in section 7.01.390, may keep and maintain on his property not to exceed ten adult spayed/neutered dogs, cats, ferrets and rabbits over the age of four months, provided that such person has first obtained from the chief of police or designee a pet fancier's permit for said dogs, cats, ferrets, or rabbits. A pet fancier shall apply every year for said permit and pay the annual fee as established in the fee schedule in section 7.04.020. Any such permit, if granted, shall be subject to such conditions as may be prescribed by the chief of police or designee, in the exercise of sound discretion, to prevent the keeping of the dogs, cats, ferrets, or rabbits from becoming a nuisance. All adult dogs, cats, ferrets, or rabbits must be licensed in accordance with this title. A pet fancier may keep and maintain animals other than dogs, cats, ferrets and rabbits according to the requirements of section 7.04.080, as applicable.

Permits are $50 annually and must be renewed every year for as long as more than 3 dogs/cats/ferrets/rabbits are maintained on property. Find the pet fancier permit application here.

Breeder/Unsterilized Dog or Cat

HMC 7.04.090 A breeder, as defined in section 7.01.140, may keep and maintain no more than:

five dogs, four months of age or older; or
five cats, four months of age or older; or
five rabbits, four months of age or older; or
three ferrets, four months of age or older,

that have not been spayed or neutered pursuant to section 7.10.010, provided that such person has first obtained from the chief of police or designee a breeder's permit for said dog(s) and/or cat(s). A breeder may not keep any combination of dogs, cats, ferrets and/or rabbits exceeding eight animals in total, whether or not said dogs, cats, and/or rabbits are in combination with spayed/neutered dogs, cats, and/or rabbits. This shall include any puppy, kitten, or kit that reaches the age of four months and remains on property. The breeder shall apply every year for said permit and pay the annual fee as established in the fee schedule in section 7.04.020. Any breeder's permit, if granted, shall be subject to such conditions as may be prescribed by the director or the county health officer, in the exercise of sound discretion, to prevent the breeding of household pets from becoming a nuisance. The permit holder shall be in compliance with all other applicable requirements under title 7. A breeder may keep and maintain animals other than dogs, cats, ferrets and rabbits in the maximum numbers and according to the types, limitations and requirements set forth in section 7.04.080, as applicable.

Permits are $200 annually and must be renewed every year for as long as there is even one unsterilized dog/cat/ferret on property regardless of animal is being bred or not. Find the breeder permit application here. Breeders must also obtain a City of Henderson business license.

Animal Handler

HMC 7.60.010 Persons operating or owning a business providing animal training service, pet care services, pet sitting, or any animal related business or service that will not be housing or possessing animals in their care or on their property, rather providing services to clients at an owner's home or property, must, in order to operate or carry on the said business, obtain an animal handler permit and a City of Henderson business license or a combination animal handler permit/license as issued in compliance with title 4.

Permits are $100 annually and must be renewed every year. Find the Animal Handler permit application here. Animal Handlers must also obtain and maintain a City of Henderson business license.

Mobile Animal Business

HMC 7.65.010 Person(s) operating or owning a mobile animal trailer or other motor vehicle unit used for the grooming of animals, transport of animals, mobile exercise service, or any other animal related business that would include the operation of a motor vehicle or trailer and have temporary care/custody of an animal in the trailer or motor vehicle, must, in order to operate said business, obtain a mobile animal business permit and a City of Henderson business license or a combination animal handler permit/license as issued in compliance with title 4. Inspection of all mobile units are required prior to approval of the permit by the director or designee.

Animal Establishment

HMC 7.70.010 No person shall conduct, operate or keep any animal establishment without first obtaining an appropriate animal establishment permit from the director or designee and a City of Henderson business license or a combination animal establishment permit/license as issued in compliance with title 4. The semi-annual permit fee for the above animal facilities shall be as established in the fee schedule by the city council.
