Basic Land Sale Process

Written bids will be accepted only at the office of the City Clerk as specified in the Notice.
At the City Council meeting set for the bid opening/auction, the written bids are opened, examined and declared, and determined to be in compliance with the resolution to sell. Oral bids are called for with the minimum acceptable bid being five percent more than the highest qualified written bid. If no written bids are received, oral bidding will begin at the appraised value of the property.
At the conclusion of the auction, Council, at its discretion, can 1) accept the highest qualified bid, 2) continue the acceptance to the next City Council meeting, or 3) reject all bids. If the bid is accepted, the Land Purchase and Sale Agreement is approved and signed. Escrow is opened.
What constitutes a qualified bid?
Written Bids
In order for a written bid to be pre-qualified, it must be in a sealed envelope with the name of the bidder, the name of the land sale and the resolution number on the outside of the envelope. The sealed bid must contain a signed Offer to Purchase letter, a signed Affidavit for Written/Oral Bids and the deposit in the form of a certified check or cashier’s check made out to the “City of Henderson or Name of Bidder”. The bidder’s name must be included on the check. For example, if the bidder is John Doe, the check should be made out to the City of Henderson or John Doe.
Oral Bids
To qualify to participate in oral bidding, the Affidavit for Oral Bids must be completed, signed, and accompanied by the required deposit (see Written Bids).
In order to participate in the oral bidding process, a bidding placard must be obtained from the City Clerk. Bidding will be distributed in the City Clerk’s Office the night of the auction between 5:00 and 6:30 p.m.
